Denkikoiji's Digital Art Commission Order Form

Please fill out this order form in as much detail as you can.

Filling out the following document is NOT a guarantee of an order. Please see my policy towards the bottom of this document regarding initiating transactions.

Convention Sketch*
These are the traditional sort of sketches that you will find offered at anime conventions. They are rather quick sketches done in a highly stylized format, and do not have as much detail as a full pencil "Digital Art" illustration. Inking these sketches increases the price from $25 to $50.

ADDITIONAL OPTIONS are available for your piece upon request and are as follows:

Adding a Simple Environment behind your character: Add another $30 to your piece
Simple Environments refer to backgrounds that are not location-specific. Instead, they might have a faded symbol in the background, or a particular wash of a color. Since this is far less time consuming than full environments, but requires some work, an additional fee is added.

Adding a Full Environment behind your character:
Add another $80 for Pencil Illustration
Add another $100 for outlined Illustrations
Add another $130 for Color Illustrations
Add another $200 for Digital Color/Painting
Full Environments are specific to locations, such as on top of buildings or in a park. As they are much more demanding of time, additional costs are added to compensate.

For additional characters (other than the character who is the primary focus of the piece), and for character illustrations with a portrait in the background, or mounts (horses etc… of any kind:
Add $25 for Pencil Illustrations
Add $25 for outlined Illustrations
Add $50 for Color Illustrations
Add $75 for Digital Color/Paintings
Each piece is assumed to have one central character that is the focus of the commission.

For a Pet/Chibi/Minion:
Add $10 for pencil/outlined pieces
Add $25 for colored pieces of any kind
Pets and minions refers to small, less-detailed animals or summons in MMO games. Chibis are small, highly cartooned versions of characters, as seen in many anime/manga drawings.

SPECIAL REQUEST POLICY:
The inclusion of specific people’s images or screenshots (your own or someone else s)

Rush ORDERS:
Rush orders can be done upon request for an additional charge depending on the complexity of the piece and the amount of time in which the piece is needed. Please make a note if this is a rush order. Also, rush orders will require 75% of the total cost as a deposit.

Please give me, in as much detail as you’d like and any ideas about the kind of piece you’re looking for. Any and all information is welcome and encouraged! Please attach those in your order. Any details about your character are also appreciated.


A 50% deposit is required for all artwork in advance of beginning the process. This deposit is non-refundable, except at the sole discretion of denkikoiji's Digital Art Commission and in extremely special circumstances.

Only completed artwork will be delivered to you—no half-finished art will be sent. In the event you, the Client, wish the work to terminate or temporarily discontinue and you communicate that wish to denkikoiji's Digital Art Commission before your commission deliverable is sent to you, the original artwork will remain the property of denkikoiji's Digital Art Commission until such time as work is reinstated at your request if ever. At which time, said art piece will be finished and delivered as originally proposed except that delivery expectations will be reasonably extended. If you terminate or temporarily halt progress on your commission before your commission deliverable is sent to you, no sum paid in advance will be refunded.

your Personal Property. denkikoiji's Digital Art Commission and the Client agree that, while the final physical art piece is your personal property to own for your private collection, denkikoiji's Digital Art Commission reserves the right to digitally post and publish copies of the produced artwork as examples for other clients (within established digital galleries/portfolios). In addition, any produced artwork might be meed for marketing purposes. However, denkikoiji's Digital Art Commission assures you that, save the prints you order specifically for your own private occur if any, no art produced through your commission will be offered as prints for others to purchase. denkikoiji's Digital Art Commission has a specific policy about creating art for commissions—your piece will not be distributed to others, my meed in my digital gallery, or portfolios, or marketing initiatives as a means of attracting other clients.

Please Note: that completing this form does NOT mean that work will begin immediately. my policy at denkikoiji's Digital Art Commission is that no work will begin until i have received this completed form, however the information given, and notified the client with official confirmation of piece details and final price. No money will exchange hands until the client is satisfied that the artist is fully informed about the particulars of the piece intended to be created. Legal Information

Definitions. The Client understands and acknowledges that as they are meed in this document “you” means the Client, and “your”, as in “your character” or “your choice of Digital art”, refer to the Client. As they are meed in this document “me” and “i” mean denkikoiji's Digital Art Commission, and “my” refers to denkikoiji's Digital Art Commission.
Miscellaneous.


1) If any commissioned artwork completion date or time frame, or delivery date or period, is communicated to you, it is an estimate only, and it is subject to delays beyond denkikoiji's Digital Art Commission’s reasonable control.


2) All payments must be made by Paypal. You are responsible for any non-me currency exchange charge.


3) To order commissions and purchase artwork you must be at least eighteen years old or have a parent pay for you.


4) Provided you have paid for it in full and do not attempt to return it or seek a credit or refund, denkikoiji's Digital Art Commission warrants that when you receive your commissioned artwork you receive the personal property title to and ownership of that artwork. Consequently you may resell that artwork or give it away as a gift if you wish. However, because of copyright law rights provided to denkikoiji's Digital Art Commission and its owners by federal statute (and the national laws of other countries) you may not modify that artwork, you may not remove the artist’s name from it if any name appears, you may not reproduce it (except by photos taken for personal Enjoyment) and then sell copies or otherwise disseminate copies in any format or by any means, and you may not otherwise use your commissioned artwork or allow its use for any commercial purpose or benefit.


5) All characters are copyright their respective creators.


6) your COMMISSION ARTWORK IS PROVIDED ON AN "AS IS" BASIS. EXCEPT FOR THE WARRANTY OF GOOD TITLE, TO THE FULL EXTENT PERMITTED BY LAW denkikoiji's Digital Art Commission DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


7) TO THE FULL EXTENT Aloud BY LAW, denkikoiji's Digital Art Commission SHALL NOT BE
LIABLE FOR ANY DAMAGES OF ANY KIND INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, EVEN IF denkikoiji's Digital Art Commission HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING DISCLAIMERS, WAIVERS AND LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY PROVISION HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE Exclusion OF OR LIMITATIONS ON CERTAIN WARRANTIES OR DAMAGES. THEREFORE, SOME OF THE ABOVE Exclusion OR LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL denkikoiji's Digital Art Commission’s AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU TO denkikoiji's Digital Art Commission PURSUANT TO THIS ART COMMISSION ORDER FORM.

8) You are responsible for your selection of your character appearing in your commissioned artwork, and for any other figures or other content you select for or require in your commissioned artwork. You are responsible for your selection of screen shots that you provide to denkikoiji's Digital Art Commission, and for their capture and reproduction by downloads, photos, printouts, or otherwise in order to provide them to me. You agree to defend, indemnify, and hold harmless denkikoiji's Digital Art Commission and its owners, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and expert fees, arising out of or in any way connected with your or denkikoiji's Digital Art Commission’s or its owner’s, contractors, or agent’s violation of the rights of any third party or violation of any law in connection with your commissioned artwork and denkikoiji's Digital Art Commission’s fulfillment of your artwork order.

9) The provisions of this Art Commission Order Form constitute the entire agreement between you and me. denkikoiji's Digital Art Commission’s failure to enforce any right or provision of this Art Commission Order Form shall not constitute a waiver of such right or provision. If one or more provisions contained in this Art Commission Order Form is/are invalid, you agree that the remainder of the provisions shall be enforceable. Any disputes arising under or in connection with this Art Commission Order Form shall be subject to the exclusive jurisdiction of the state and federal courts of the United State.
